NEW FEDERAL RULES FOR RENOVATION & PAINTING
OLDER BUILDINGS

The EPA has new rules effective on April 22, 2010 on Renovation and Repairing of Painted surfaces in buildings built prior to 1978 or in buildings with children.~ Contractors doing window removal or painting must be certified and must follow certain safety procedures. ~Only one certification training will be available in Key West and that is on April 15. ~To find out more about the 1-day training that costs $285 go to www.rrp-training.com.

Fortunately these new renovation and painting rules do not require testing or removal of lead-based paint, only safety procedures. ~However, property managers and contractors can be fined $38,000 a day for violating these new rules.

As per the State Department of Business and Professional Regulation’s website, Certified and registered residential, building and general contractors are no longer authorized to obtain permits to perform roofing and re-roofing repairs following the expiration of the Executive Orders, which were signed in response to the 2004 and 2005 hurricane seasons. Jobs for which permits were pulled prior to the expiration of the Executive Order may be completed.

EFFECTIVE MARCH 1,2009, ALL PERMIT APPLICATIONS AND PLANS SUBMITTED TO THE BUILDING DEPARTMENT MUST COMPLY WITH THE NEW 2007 FLORIDA BUILDING CODE.

The Building Department is responsible for the administration and enforcement of all ordinances applicable to building, construction, blasting and explosives as defined in the Monroe County Code.
Building Officials are charged with administering and ensuring compliance with the building code. This section issues building and construction permits and Certificates of Occupancy. It also supervises blasting within the County.
Inspectors in each of three areas of expertise are assigned to the County offices in Key West, Marathon, and Plantation Key. At specified stages in the construction of buildings, the contractor or builder must call for an inspection by the appropriate official, ie: the building inspector, the plumbing inspector, or the electrical inspector before he may proceed with construction and prior to issuance of a Certificate of Occupancy. The Certificate of Occupancy is required prior to beginning use.

General Permit Information
Prior to commencing construction, a contractor or owner/builder must first make application to obtain a permit. Obtaining a permit may require the interaction and approval of several agencies outside of the Building Department, and with small exception, there are fees charged by each of these agencies for their review procedures. The Building Department works to coordinate the involvement of these other agencies in the permitting process to obtain a building permit in the most expedient manner while maintaining the County’s high level of quality. This service should not be viewed as a substitute for a customer’s responsibility to interact with each of the various agencies.
The other agencies that are tracked by the computerized network of the Building Department, and are most commonly involved in the permit process include, but are not limited to:
·       Monroe County Planning Dept.
Depending upon the location and use of the proposed improvement, the following agencies may also be involved in the processing of a permit:
Design reviews may be secured prior to permit application. Applicants may apply to many of the outside agencies independently, prior to applying for a building permit, and are strongly advised to do so, when applicable. Not all agencies are required by statute to adhere to strict processing timelines in a manner similar to the Building Division. Documents required for approval by other agencies may not be the same, or as complex, as those required for Building Code review.
Receipt of a building permit may not indicate approval from all agencies having jurisdiction (i.e.: State and Federal agencies), compliance with deed restrictions, or adherence to homeowners or other association rules. The applicant is responsible for compliance with these and any other agency requirements outside of the Building Permit process.
Permit applications should generally be submitted in three identical sets. The application package should generally include a completed permit application, a property record card, detailed plans, and all product approvals, a property survey and outside agency approvals as required.  Please contact your local building department office for specific lists of items required.
At the time of application, a brief intake evaluation will be performed, establishing the permit type (scope of work) and utilizing an application sufficiency checklist. At the time of submittal a non refundable application fee will be required and the customer will be given an application receipt and assigned a permit number. Application fees will be deducted from the total permit fees at the time the permit is issued.  
You will need the permit number to check the status of your application. You can track the progress and status of your application by logging on to One-Stop Shop. The applicant will be contacted if any deficiencies are found during the review process, and when the permit is ready to be picked up. The more complete and accurate the permit application, the more expeditiously an application review and building permit issuance can be achieved.
